The RadioWeb service & website is operated by Content Media India Private Limited a company registered in India with its registered office at Q 1106 , Purva Fountainsquare , Munekolala , Varthur Hobli, Bangalore , India , 560 037
By using the RadioWeb Service you accept and agree to be bound by the following terms and conditions (the ‘Terms of Service’). Where applicable under law, these Terms constitute a written agreement signed by you

In the event that you are a minor (the age of minors is determined by local law where you reside). You confirm that you have received your parent’s or guardian’s consent to enter into this Agreement. By registering for the RadioWeb Service, you represent and warrant that you are not a “Minor” acting without the consent and supervision of a parent or legal guardian and that you have the capacity to understand, agree to and comply with the terms of this Agreement.
4. Account Confidentiality
You agree that you will not allow others to use any aspect of your Account Information or Account. You have responsibility for taking steps to maintain the confidentiality and security of your Account. You agree to notify us immediately of any unauthorized use of your password and/or Account. Content Media will not be responsible for any losses arising out of the unauthorized use of your member name, password and/or Account and you agree to indemnify and hold harmless Content Media, its partners, parents, subsidiaries, agents, affiliates and/or licensors, as applicable, for any improper, unauthorized or illegal uses of the same.
6. Term and termination
This Agreement will become effective when you create an Account on RadioWeb and accept the terms of this Agreement as part of the account creation process and will remain effective until terminated by you or terminated by us.
Content Media reserves the right to terminate this Agreement or suspend your Account at any time in case of unauthorized, or suspected unauthorized use of the RadioWeb Service whether in contravention of this Agreement or otherwise. If Content Media terminates this Agreement, or suspends your Account for any of the reasons set out in this section, Content Media shall have no liability or responsibility to you, and Content Media will not refund any amounts that you have previously paid.
7. Subscription , renewal and cancellation
7.1 - If you choose to become a subscriber to the RadioWeb Services, you agree to pay the relevant fee for the service you select. Payment will be taken when you first subscribe for the RadioWeb Services and will last for the term chosen at the time of subscription. You will be asked to provide valid registration information, a valid payment method, and other payment information at the time of purchase.
7.2 - By subscribing to the RadioWeb services, you authorize Content Media to charge the chosen subscription fee amount to the payment method that you provided at the time of purchase. You confirm that you are authorized to make such purchase and that you are the authorized to operate the payment method chosen or is used with permission of your parent or guardian.
7.3 - The subscription fee is exclusive of any applicable national, state or municipal taxes or duties.
7.4 - Your subscription will automatically renew at the end of each subscription term unless you terminate your subscription prior to the end of such subscription term .Such renewal will be for the same subscription term as the previous subscription term. At the time of renewal the payment method you have designated to be charged for the purchase of the subscription will automatically be charged with the applicable amount.
7.5 - You may change the period for the renewal of the subscription at any time prior to the end of such subscription term or choose not to renew your subscription.
7.6 - You may cancel your RadioWeb subscription at any point during your subscription and receive a pro-rated refund of the subscription fee for any unused months of your current subscription period (partial months will not be refunded).
7.7 - You may not transfer your RadioWeb subscription, or share your RadioWeb Account and subscription with any third party. You may only use your subscription and the RadioWeb service for personal, non-commercial purposes.
8. Free Trial
Content Media may, in its sole discretion, offer a one-time, free trial to first-time RadioWeb subscribers (“Free Trial”), which provides listeners with the benefits of a RadioWeb subscription for no charge during the designated Free Trial period. The length of any Free Trial period may vary. In order to participate in a Free Trial, you must be a registered RadioWeb user. Unless otherwise stated in the applicable Free Trial offer, if you are a current RadioWeb subscriber or have previously participated in a Free Trial, you are not eligible to receive a Free Trial. During the Free Trial, you will receive the benefits of a RadioWeb subscription for no charge. Prior to or upon expiration of the Free Trial period, Content Media may, in its sole discretion, notify you that your Free Trial is about to expire or has expired, and ask if you wish to purchase a RadioWeb subscription. Free Trials are subject to these Terms, to the extent applicable.
Content Media may change the subscription fee amount from time to time. Any changes will take effect after the expiry of the then current paid for subscription period (i.e. the term that you have already paid for), and will not apply retroactively or to the remainder of your current subscription period. Any price changes will be communicated on the website.
10. User Conduct and Appropriate Content
You are allowed to access your RadioWeb service account from a single device at any one time.
The RadioWeb service is made available for your personal non-commercial use only. You may not use the Service for any illegal or unauthorized purpose.
International users agree to comply with all local rules regarding online conduct and acceptable content. You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links and other content (‘Materials’) that you submit, post, and display on the RadioWeb Service or RadioWeb pages on other services (e.g. Facebook , twitter etc. ).
We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party’s intellectual property or other proprietary rights or these Terms. Further, under no circumstances does Content Media have any obligation to check the accuracy or truthfulness of any Materials, nor to monitor any User’s use of the RadioWeb Service. Content Media cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
You agree that Content Media is not responsible for content once it is shared to any third party service
If you use any social networking facility on RadioWeb or on any RadioWeb pages on any third party service, you must respect other users of such service in your interactions with them. Content Media reserves the right, in its absolute discretion, to disable your account if it believes that you are violating this principle. Unacceptable behavior will result in your account being terminated and you being blocked from accessing the RadioWeb service.
11. Restrictions on Use
For the avoidance of doubt, you agree that you may not (without limitation):
(a) copy, reproduce, “rip”, record,, distribute , make available to the public or otherwise use any part of the RadioWeb service ,copyrighted materials , its content (including but not limited to programmes , tracks, images and text) in a manner not expressly permitted under this Agreement;
(b) copy, store, edit, change, prepare any derivative work of or alter in any way any of the content streamed through the RadioWeb Services
(c) make the RadioWeb services available over a network where it could be used by others
(d) sell or attempt to sell any invite to access the RadioWeb service
(e) provide your password to any other person or use any other person’s user name and password;
(f) translate, reverse engineer, decompile, disassemble, modify or create derivative works based on the RadioWeb services or any part thereof ;
(g) circumvent any technology used by Content media , its licensors, or any third party to protect content accessible through the RadioWeb service ;
(h) rent or lease or sub-licence any part of the RadioWeb service ;
(i) use the RadioWeb service in a way that violates the terms of this Agreement;
In addition to the above, you agree to take all reasonable care to prevent unauthorized use of the RadioWeb service and its content. You also acknowledge and agree that Content Media may remove or reclaim your username at any time if Content Media in its absolute discretion considers such action appropriate.
12. Service Suspensions
Content Media will make reasonable efforts to keep the RadioWeb service and website operational. However, certain technical difficulties, routine site maintenance/upgrades and any other events may, from time to time, result in temporary service interruptions. Content Media also reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, functions of the RadioWeb service with or without notice. You agree that Content Media shall not be liable to you or to any third party for any of the direct or indirect consequences of any modification, suspension, discontinuance of or interruption to the RadioWeb Service.
Content Media owns or has a license to all title and copyrights in and to the RadioWeb services, including content on this site, such as text, graphics, logos, button icons, audio clips, digital downloads, data compilations, and software. All title and intellectual property rights in and to the licensed content in the RadioWeb services are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties and subject to use restrictions under such laws or treaties.
The RadioWeb service may contain third-party trademarks, service marks, graphics, and logos. You are not granted any right or license with respect to RadioWeb trademarks or the trademarks of any third party.
Unless expressly authorised by us, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from materials or content available on the RadioWeb website. Notwithstanding the above, you may use the content and materials on the Website in the course of your normal, personal, non-commercial use of the RadioWeb website.
14. Internet Access
Content Media shall not be responsible for any connection or access to the RadioWeb website by you or the quality of the transmission of any information passing between you and the website. You will be responsible for providing your own communications equipment to access the RadioWeb website via the Internet, and the Internet access charges thereon.
15.1 - The RadioWeb services (including any software contained therein) and any upgrades or plug-ins and any licensed content are licensed to you “as is.” any use of the RadioWeb services will be at your own risk. To the maximum extent permitted by applicable law, Content Media disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. RadioWeb makes no representations or guarantees that the RadioWeb services will be free from loss, destruction, damage, corruption, attack, viruses, interference, hacking, or other security intrusion, and Content media disclaims any liability relating thereto.
15.2 - Content Media makes no guarantees, representations, or warranties that use or results of the use of the RadioWeb services will be accurate, reliable, current, uninterrupted or without errors. Without prior notice, Content Media may modify, suspend, or discontinue the RadioWeb services (including any content) or your use of them. Whenever Content Media elects to modify, suspend, or discontinue the RadioWeb services, it will not be liable to you or any third party.
15.3 - You acknowledge that your submission of any information to us is at your own risk. Content Media does not assume any liability to you with regard to any loss or liability relating to such information in any way.
15.4 - Some of the content, products, and services available through the RadioWeb services may include materials that belong to third parties. You acknowledge that Content Media assumes no responsibility for such content, products or services.
You agree to hold harmless and indemnify Content Media its subsidiaries, affiliates and their respective owners , directors , officers , managers and employees, from and against any third party claim arising from or in any way related to your use of or conduct on the RadioWeb Service, including any liability or expense arising from all claims, liabilities, losses, damages (actual and consequential), suits, judgments, litigation costs, expenses, and attorneys’ fees arising out of (i) your breach of this agreement, including, but not limited to, any infringement by you of the copyright or intellectual property rights of any third party; or (ii) your use of the RadioWeb services
17. Limitation of Liability
17.1 - in no event will Content Media ( including its subsidiaries, affiliates and their respective owners , directors , officers , managers and employees ) be liable to you for any direct , indirect, general, special, incidental, consequential, exemplary or other damages (including, without limitation, damages for loss of profits, goodwill , use, data, business interruption, corruption of files, loss of information or any other pecuniary loss), whether based on contract , tort or otherwise , arising out of or in connection with the use of , or inability to use the RadioWeb Service , whether or not Content Media has been advised of the possibility of such damage or loss.
17.2 - Such limitation of liability shall apply (i) whether the damages arise from use or misuse of and reliance on the RadioWeb Service, from inability to use the RadioWeb Service, or from the interruption, suspension, or termination of the RadioWeb Service (including such damages incurred by third parties), and (ii) notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law. If you are dissatisfied with the RadioWeb Service or any part of the RadioWeb Service you’re sole and exclusive remedy is to discontinue using the RadioWeb Service and any related website.
17.3 - Some jurisdictions do not allow the exclusion of implied warranties or limitation or exclusion of liability for incidental or consequential damages, so the above exclusions and limitations may or may not apply to you. In such cases, Content Media’s entire liability and your exclusive remedy under this agreement will be limited to Indian rupees One hundred (Rs. 100) or equivalent amount in foreign currency. .
18. Third parties
18.1 - Content media or its business partners may present advertisements or promotional materials on or through the RadioWeb service or website. Your dealings with, or participation in promotions of any third-party advertisers on or through the site are solely between you and such third party and your participation is subject to the terms and conditions associated with that advertisement or promotion. You agree that Content Media is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third parties on the site.
18.2 - Content Media on or through the RadioWeb service or website may present links to third-party Web sites or third-party services not owned or operated by us. We are not responsible for the availability of these third-party sites or services or their contents. You agree that we are not responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with your use of or reliance on any content of any such third-party site or services or goods or services available through any such third-party site or service.
19. Applicable law
These Terms of Service will be governed by and construed in accordance with the laws of India, without giving effect to its conflict of law’s provisions or your actual state or country of residence.
Any dispute relating to the Agreement shall be submitted to confidential arbitration in Bangalore, India, Arbitration under this agreement shall be conducted under the rules of the Indian Arbitration Act. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
Content Media may assign this Agreement or any part of it without restrictions. You may not assign this Agreement or any part of it to any third party.
22.1 - Without limiting the foregoing, under no circumstances shall Content Media be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.
22.2 - Should for any reason or to any extent any provision of this Agreement be held invalid or unenforceable, such invalidity or enforceability shall not in any manner affect or render invalid or unenforceable the remaining provisions of this Agreement and the application of that provision shall be enforced to the extent permitted by law.
